Do I need a building permit to build a deck?

Wooden decks located within the Village may be built only after an appropriate building permit has been secured through the Building Department. Decks are structures that are required to meet local Zoning and New York State Building Code Compliance. In planning for a deck, it is suggested that you meet with the Building Inspector to review your submission to assure that the aforementioned zoning and building code criteria are met.

The importance of adequate structural design is imperative, given the fact decks tend to be a gathering area during family functions. All decks must be designed to withstand a minimum uniformly distributed live load of forty (40) lbs. per square foot. Furthermore, the design must be done by a licensed New York State Architect or Engineer. Plans submitted should depict the following:

  • l Pier location plan
  • l Joist size and spacing
  • l Decking material
  • l Railing details
  • l Section view Plot plan ? showing setbacks to property lines

Once these items have been reviewed to the Building Department?s satisfaction, an appropriate building permit will be processed. During the construction time frame, footing and framing inspections are required. Upon completion of the deck, an updated survey by a licensed New York State Land Surveyor is required to assure Zoning Compliance. At this time a certificate of occupancy for the deck would be issued which legalizes its construction.

Be advised that decks constructed without required permits will appear in a title search, which will lead to delays in the sale of your residence or when refinancing. A deck is not just a deck, it?s an assembly of materials that must be constructed properly to assure your safety.
